Forestry ETS Form - Applying for Exemption (Less than 50 Ha)

Purpose of form

To apply for a less than 50 hectare exemption from the pre-1990 forest land deforestation obligations of the Climate Change Response Act 2002.

When to use this form

  1. The person who owned (along with any associated persons) as at 1 September 2007 less than a total of 50 hectares of pre-1990 forest land, and
  2. An exemption is sought from the deforestation obligations of the Climate Change Response Act 2002.

Who should use this form

The current landowner(s) pre-1990 forest land seeking the exemption.

Information you need to complete the form

  • the name and contact details of the current landowner(s) seeking the exemption;
  • the name and contact details of the landowner(s) as at 1 September 2007;
  • a completed statutory declaration signed by each person who owned the land as at 1 September 2007 (other than a joint tenant who is a professional trustee);
  • evidence of the deforestation having taken place;
  • the legal description of the deforested land, such as:
    • Land Parcel or Block description;
    • Certificate of Title (Computer Register) reference;
    • Maori Land Court reference;
    • Deed reference.

Additional information that must accompany the form

  • an electronic shapefile (.shp) of the deforested land area and forest attributes that meets the Mapping Standard saved to CD or DVD media.

There are no subsequent requirements.

You can submit a pre-1990 Apply for Deforestation Exemption (less than 50 Ha) form online or by printing, completing and sending the form Apply for Deforestation Exemption (less than 50 Ha) along with the statutory declaration(s) to MPI by email or postal mail.
