Forestry ETS Form - Transfer of Participation (Transfer)

Participants who have been registered with respect to post-1989 forest land may make certain changes to their registration; in some cases they are obligated to make changes. These changes will affect the post-1989 forest land registered in relation to a particular participant.

Purpose of form

To notify that post-1989 forest land should be transferred from one registered participant to another person who should become the registered Participant for that forest land, in certain circumstances.

This form acts as a joint notification by the Transferor and the Transferee and contains sections that must be completed by each.

When to use this form

Use this form in the following circumstances relating to some or all post-1989 forest land that is already registered in the ETS. In each circumstance a mandatory transfer of registered participant occurs in respect of the affected post-1989 forest land:

  • The registered forest land is sold to a new land owner (new land owner becomes the registered participant in respect of the affected forest land);
  • A registered forestry right, registered lease or Crown conservation contract relating to the forest land is transferred by way of assignment to another party (new assignee becomes the registered participant in respect of the affected forest land);
  • A brand new registered forestry right, registered lease or Crown conservation contract is created over the forest land (new right/leaseholder or contracting party becomes the registered participant in respect of the affected forest land);
  • A “transmission” occurs from a registered post-1989 participant to another party for example via inheritance, court order or other legal mechanism (the other party becomes the registered participant in respect of the affected forest land).

Who can use this form

A participant who is already registered in respect of post-1989 forest land.

Information you need to complete the form

  • the name and contact details of the person submitting the notification;
  • Transferor and Transferee participant names and holding account numbers;
  • a list of CAA numbers that are affected by the land transfer
  • the legal description of the transferred land:
    • Land Parcel or Block description;
    • Certificate of Title (Computer Register);
    • Maori Land Court reference;
    • Deed reference.

Subsequent Obligations

The Transferor must file a Mandatory Emissions Return (Transmission) (PDF, 82 KB) within 20 working days. 

The Transferee will take on an obligation to file an emissions return (final) (available from September 2012) between 1 January and 31 March 2013.

You can submit a Post-1989 Transfer of Participation (Transfer) form by printing, completing and sending the form Post-1989 Transfer of Participation (Transfer) to MPI by postal mail.
