Customary regulations for the Tītī/Muttonbird Islands

Regulations implemented

The Tītī/Muttonbird Islands’ birding community traditionally gathers kaimoana, particularly shellfish, while on the islands for the tītī harvest. In June 2015, the Government agreed to make regulations to recognise and provide for this customary food gathering and the special relationship between the Tītī Islands birding community and areas around the islands.

The regulations were implemented through amendments to the Fisheries (Southland and Sub-Antarctic Areas Commercial Fishing) Regulations 1986 which came into effect on 9 July 2015. The regulations:

  • prohibit the commercial harvest of kina and paua in 25 areas;
  • prohibit the commercial harvest of kina, alone, in 5 areas; and
  • prohibit the commercial harvest of paua, kina and rock lobster in 1 area.

Consultation process

Consultation was originally opened in May 2010 and was undertaken by the then Ministry of Fisheries. The submission period closed on 16 June 2010. Details of the Ministry of Fisheries’ consultation and copies of information that was released in 2010 can be found below.

In October 2014, the Ministry for Primary Industries wrote to submitters to ask if they had any new information or any change to their submissions. Submitters were sent copies of their submissions and the initial position paper from 2010. In response to a query from a submitter, a follow up email was sent to submitters to provide details of changes made to the original proposal and updated maps.

Consultation on 4 Regulatory Proposals for December 2010

MFish is consulting with stakeholders and tangata whenua on 4 proposals that could result in changes to regulation. If approved, these regulations would take effect in December 2010.
